They are not charging him with 1st degree murder - they can't because they don't have the body to prove premeditation. The jury has to listen to all of the facts and come to a decision as a whole group, there can be no doubt.

Once he is tried with her murder he can not be tried again for the same crime. If they acquit him and find him not guilty, he could walk out and say I killed her and they could not criminally charge him with murder and they can not change the penatly of the time or the charge of the sentence.

Yeah, double jeopardy. I wasn't sure if there were addendum's to this law.

They could retry him if they had new evidence though, correct? Lets say, a body?

AND...he is being tried for 2nd degree right now...gets off "not guilty" then they find body, so then they try him for 1st degree, which literally speaking is a different crime.

I am pretty sure they can not retry him for the same crime even with new evidence. If they use the body to try him again (which I don't think they can) they can't use ANY of the evidence from the first trial - so no dna - no swords - nothing.

Double jeopardy works for the same crime, like you said. But if he gets off this, then find a body, they can charge him with 1st degree, which is different. As for using the old evidence? I think you might be right there.

Think about it this way. O.J. was charged with 1st degree murder. You cannot get any worse than that. So by coming out and saying the crap he is cannot come back to hurt him. They had the bodies,etc....

Question:

If the jury finds him not guilty of second degree murder can the prosecution present a case and charge him with the commission of a felony, say an assault on her, without double jeopardy applying? Or does double jeopardy apply to any other charges the prosecution would want to charge him with?
