Back to the topic re: Matt Higgins, is this one of the first murder cases he's done? I thought he was mostly a divorce/dui lawyer.

ddd - I agree that if this boy committed the murder than he needs to be punished. I could also tell you that I think he did it, but my opinion doesn't matter. What does matter is that he is charged with second degree murder and use of a weapon to commit a felony. In our courts, even guilty people get a lawyer, and that means a real, tough-as-nails, aggressive advocate, not someone just going through the motions.

Then it is up to a jury to determine outcome of the case. Not only does the jury get to determine his innocence or guilt but they have to do it according to the law and not their opinions. The jury is to make their decision based on the evidence presented and the arguments made by the opposing attorneys. Matt's job is to present the most effective case possible in opposition to the prosecution.

As hard as this is for the family and I have no idea how difficult this must be for them - they would want to make sure that the right person is convicted. There shouldn't be a conviction, without the defendant's rights vigorously safeguarded. The defense lawyer's job in every trial is to look for reasonable doubt and to hold the prosecutors' feet to the fire, and our system depends on it. It's the defense lawyer who will call attention to police misconduct, holes in the evidence, and the state's failure to prove its case (which none of these will be an issue in this case). Mistakes by the defense could allow the imprisonment of an innocent person, but mistakes by the state could cause a murderer to go free.

Matt has stated that his client is innocent. Hmm.. A lawyer cannot knowingly place a witness on the stand to perpetrate a lie, nor can a lawyer knowingly lie to the court. So what does that mean?? So if this kid told Matt that he didn't do it then that is what Higgins would have to say.

Believe me I know this is frustrating.. I guess all we can do is wait..

By the way ddd - thanks for posting your thoughts.. and thanks for not making personal attacks (even against Higgins - he is just doing his job - something I could never do or would want to).

ddd, I think we all agree that we think the guy is guilty, but making a statement like "he will be convicted" just doesn't fly with me since O.J. Anything can happen, and hopefully the victim's family will get justice.

Don't forget Jackson........ We all know the guy is guilty as sin of molestation.... But the prosecution brought a weak case and the defense blew holes through it......

Let the Police and the Court do their jobs and question everything the media presents to you.....

I don't believe the death penalty is an option for a second degree murder charge. I think the most he can get is 25 to life and 25 for the weapons charge. Without a body the prosecutor has wisely chosen the correct charge.
