I'm curious (because, obviously I have been living under a legal rock, so to speak), as to why it is 2nd degree rather than 1st degree murder?

Second-degree murder is ordinarily defined as 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion" or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life.

While first degree murder is both willful and planned.

He was not charged with first degree because they cannot prove that this was a planned murder.

this thread is an interesting read. a little research on how the citizens of tntu feel about miss o'grady and her murderer prior to being called a lonely sick fuck might be in order.

Their clients "rights" protected? Bulls***! These murderers hire the lawyers to get the not guilty verdict, whether the lawyer knows they are guilty or not. Not to make sure their so called "rights" are protected. Besides, these people lost their rights when they violated another human being's right to live.

Mike.. I agree with you.. however in the legal system a person is innocent until proven guiltily ... That has nothing to do with my personal feelings that a SUSPECT is guilty but they still deserve a FAIR trial. Attorneys will use the law to defend their clients and protect their rights, however an attorney can't lie to the court. If the attorney knows that the person is guilty then the attorney can NOT say that he/she is innocent in the courtroom. The attorneys are only allowed to do what the law allows them to do - nothing more.

That's crap I've been to court a ton of times ...for some pretty serious stuff more than a few times...And not only did my lawyer know i was guilty he helped me change up my story and lie ..... I've used a few different lawyers in my time and all are pretty prominent and you would all know their names... But i will not throw them under the bus and post their names because i might need them again because they were good and they got me off more than a few times...Don't believe for a minute that they can't lie and they won't . that's how they win and that's how they get paid. and that's how they get more clients from word of mouth from other people they got off .. When you tell someone this guy will do whatever it takes to get you off that's what it means. That's how i found the lawyers i needed and that's how people i referred to them found them
